§ 1
GENERAL PROVISIONS
- The www.liemhome.com Store operates on the principles set out in these Regulations.
- The Regulations specify the conditions for concluding and terminating Product Sales Agreements and the complaint procedure, as well as the types and scope of services provided electronically by the www.liemhome.com Store, the principles of providing these services, the conditions for concluding and terminating agreements for the provision of services electronically.
- Each Service Recipient is obliged to comply with the provisions of these Regulations upon taking action to use the Electronic Services of the www.liemhome.com Store.
- In matters not regulated in these Regulations, the provisions of:
- the Act on the provision of services by electronic means of 18 July 2002,
- the Consumer Rights Act of 30 May 2014,
- the Act on out-of-court resolution of consumer disputes of 23 September 2016,
- the Civil Code Act of 23 April 1964,
- and other relevant provisions of Polish law shall apply.
§ 2
DEFINITIONS INCLUDED IN THE REGULATIONS
- REGULATIONS – these regulations of the Store.
- STORE – the Service Provider's online store operating at www.liemhome.com
- ELECTRONIC SERVICE – a service provided electronically by the Service Provider to the Service Recipient via the Store.
- CONTACT FORM – a form available on the website www.liemhome.com enabling sending a message to the Service Provider.
- REGISTRATION FORM – a form available on the website www.liemhome.com enabling the creation of an Account.
- ORDER FORM – a form available on the website www.liemhome.com enabling the placement of an Order.
- OPINION SYSTEM – an Electronic Service made available to Customers by the Service Provider, enabling the posting of opinions regarding Products.
- CUSTOMER – a Service Recipient who intends to conclude or has concluded a Sales Agreement with the Seller.
- CONSUMER – a natural person who enters into a legal transaction with an entrepreneur that is not directly related to their business or professional activity.
- ENTREPRENEUR – a natural person, legal person and organizational unit that is not a legal person, to which the law grants legal capacity, conducting business or professional activity on its own behalf.
- ACCOUNT – a collection of resources in the Service Provider's IT system marked with an individual name (login) and password, in which the Service Recipient's data is collected, including information about placed Orders.
- NEWSLETTER – an Electronic Service that allows the Service Recipient to subscribe and receive free information from the Service Provider regarding the Store and the Products available therein to the e-mail address provided by the Service Recipient.
- PRODUCT – a movable item or service available in the Store, which is the subject of the Sales Agreement between the Customer and the Seller.
- SELLER, SERVICE PROVIDER – LIEM SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ: address for service: UL. SZLAK 77, lok. 222, KRAKÓW 31-153, NIP: 6762639399, REGON: 52481338700000, e-mail address: info@liemhome.com, telephone number: +48 517 341 267.
- SALES AGREEMENT – Product Sales Agreement concluded between the Customer and the Seller via the Store.
- SERVICE RECIPIENT – a natural person, legal person or organizational unit without legal personality, to which the law grants legal capacity using the Electronic Service.
- ORDER – a declaration of will of the Customer constituting an invitation to conclude a Product Sales Agreement with the Seller.
- PRICE – value expressed in monetary units that the Customer is obliged to pay to the Seller for the Product.
§ 3
INFORMATION ON PRODUCTS AND ORDERING THEM
- The www.liemhome.com Store conducts retail and wholesale sales of Products, including on special order according to the Customer's Specification, via the Internet in the European Union and in other countries indicated by the Seller.
- The Products offered in the Store are new, in accordance with the agreement and have been legally introduced to the Polish market.
- The information on the Store's websites does not constitute an offer within the meaning of the law. By placing an Order, the Customer makes an offer to buy a specific Product on the terms specified in its description.
- The price of the Product displayed on the Store's website is given in Polish zloty (PLN) or in euro (EUR) and includes VAT. The price does not include customs duties, import taxes and delivery costs.
- The price of the Product displayed on the Store's website is binding at the time the Customer places an Order. This price will not change regardless of price changes in the Store, which may occur in relation to individual Products after the Customer places an Order.
- The Seller clearly informs Customers about Unit Prices and promotions and price reductions of Products. In addition to information about the Product reduction, the Seller displays the lowest Price of this Product that was applicable in the period of 30 days before the introduction of the reduction, and if the Product is offered for sale for a period shorter than 30 days - the Seller displays the lowest Price of the Product that was applicable in the period from the day on which this Product was offered for sale to the day on which the reduction was introduced.
- Orders can be placed: via the website using the Order Form (Shop www.liemhome.com) - 24 hours a day all year round; via e-mail to the address: info@liemhome.com.
- In order to place an Order, the Customer is not obliged to register an Account in the Store.
- The condition for placing an Order in the Store by the Customer is to read the Regulations and accept their provisions at the time of placing the Order.
- The Store processes Orders placed from Monday to Friday during Store business hours, i.e. from 8:00 to 16:00 on business days. Orders placed on business days after 16:00, on Saturdays, Sundays and public holidays will be processed the next business day.
- Products on sale (sale) have a limited number of items and Orders for them will be processed in the order in which they are received until the stocks of a given Product are exhausted.
§ 4
CONCLUSION OF A SALES AGREEMENT
- To conclude a Sales Agreement, it is necessary for the Customer to place an Order in advance using the methods provided by the Seller, in accordance with § 3 points 7 and 9 of the Regulations.
- After placing the Order, the Seller shall immediately confirm its receipt.
- Confirmation of acceptance of the Order, referred to in point 2 of this paragraph, binds the Customer with their Order. Confirmation of receipt of the Order is made by sending an e-mail message.
- Confirmation of receipt of the Order includes: confirmation of all essential elements of the Order; a withdrawal form from the agreement; these Regulations containing instructions on the right to withdraw from the agreement.
- A Sales Agreement is concluded between the Customer and the Seller upon receipt by the Customer of the e-mail message referred to in point 4 of this paragraph.
- Each Sales Agreement will be confirmed by proof of purchase..
§ 5
PAYMENT METHODS
- The Seller provides the following payment methods: payment by traditional transfer to the Seller's bank account; payment via an electronic payment system (PayPal, Przelewy24, Credit Card).
- In the case of payment by traditional transfer, the payment should be made to the bank account number: 52 1140 2004 0000 3712 2328 7133 (mBank A.) LIEM SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, UL. SZLAK 77, lok. 222, KRAKÓW 31-153, NIP: 6762639399. In the title of the transfer, enter "Order No. ...".
- In the case of payment via an electronic payment system, the Customer makes the payment before the Order is processed. The electronic payment system allows payment by credit card or quick transfer from selected Polish banks.
- The payment card operator is PayPro SA Agent Rozliczeniowy, ul. Kanclerska 15, 60-327 Poznań, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court of Poznań Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under the KRS number: 0000347935, NIP: 7792369887, REGON: 301345068.
- The Customer is obliged to pay the price under the Sales Agreement within 7 business days from the date of its conclusion, unless the Sales Agreement provides otherwise.
- In the event of choosing the payment described in points 1.1 and 1.2 of this paragraph, the Product will be sent only after it has been paid for..
§ 6
COST, TIME AND METHODS OF DELIVERY OF THE PRODUCT
- The costs of delivery of the Product, which are covered by the Customer, are determined during the process of placing the Order and depend on the choice of payment method and delivery method of the purchased Product.
- The delivery time of the Product consists of the production time of the Product and the time of delivery of the Product by the carrier: The production time of the Products is from 2 to 10 working days (in the case of roller blinds from 2 to 15 working days) from the moment of: Posting of funds paid under the Sales Agreement to the Seller's account or positive authorization of the transaction by the electronic payment system.
- Delivery of Products constituting movable items by the carrier takes place within the time declared by him, i.e. from 7 to 14 working days from the moment of sending the shipment (delivery takes place only on working days, excluding Saturdays, Sundays and holidays).
- Products purchased in the Store are sent via Poczta Polska or a courier company (DPD, UPS, Fedex, DHL, InPost, Ambro Express, Poczta Polska).
- In the event of sending the Product abroad, the Customer is obliged to pay all customs duties due in the country of receipt of the shipment.
- In the event of the shipment being detained by a customs office and the need to pay customs duties for it, the Customer cannot request the cancellation of the Order..
§ 7
PRODUCT COMPLAINT
- The basis and scope of the Seller's liability towards the Customer who is a Consumer or an entity referred to in § 10 of the Regulations, for the lack of conformity of the Product with the contract, are specified in the Consumer Rights Act of 30 May 2014,
- The basis and scope of the Seller's liability towards the Customer who is an Entrepreneur, referred to in § 9, under the warranty are specified in the Civil Code Act of 23 April 1964,
- The Seller is liable towards the Customer who is a Consumer or an entity referred to in § 10 of the Regulations, for the lack of conformity of the Product with the contract, existing at the time of delivery of the Product and revealed within 2 years from that moment, unless the expiry date of the Product specified by the Seller or persons acting on his behalf is longer,
- Notification of the lack of conformity of the Product with the contract and submission of an appropriate request can be made via e-mail to the following address: info@liemhome.com or in writing to the following address: UL. SZLAK 77, lok. 222, KRAKÓW 31-153.
- In the above message in written or electronic form, as much information and circumstances concerning the subject of the complaint should be provided as possible, in particular the type and date of the irregularity and contact details. The information provided will significantly facilitate and speed up the processing of the complaint by the Seller.
- In order to assess the irregularity and non-conformity of the Product with the contract, the Consumer or the entity referred to in § 10 of the Regulations are obliged to make the Product available to the Seller, and the Seller is obliged to collect it at its own expense,
- The Seller will respond to the Customer's request immediately, no later than within 14 days from the date of filing the complaint.
- In the event of a complaint from a Customer who is a Consumer or an entity referred to in § 10 of the Regulations - failure to consider the complaint within 14 days of its submission is tantamount to its acceptance,
- The Customer may first request the replacement or repair of the Product by the Seller. The Customer may request a price reduction and withdrawal from the contract only in the cases specified in the Consumer Rights Act of 30 May 2014 (including when the non-conformity of the goods with the contract is significant, when the Seller has refused to bring the goods into conformity with the contract or when the non-conformity of the goods with the contract persists despite the seller's attempts to bring the goods into conformity with the contract),
- In connection with a justified complaint from a Customer who is a Consumer or an entity referred to in § 10 of the Regulations, the Seller shall, as appropriate:
- cover the costs of replacement and re-delivery of the Product to the Consumer,
- cover the costs of repair and re-delivery of the Product to the Consumer,
- reduce the price of the Product (the reduced price must be in proportion to the price of the goods in conformity with the contract to the goods inconformity with the contract) and return the value of the reduced price to the Consumer or the entity referred to in § 10 no later than within 14 days of receiving an authorized statement from such Consumer or entity referred to in § 10 on price reduction,
- in the event of a legitimate withdrawal from the contract by the Consumer or the entity referred to in § 10 - refunds the price of the Product no later than 14 days from the date of receipt of the returned goods or proof of their return. In the event of withdrawal from the contract, the Consumer or the entity referred to in § 10 is obliged to immediately return the goods to the Seller at the Seller's expense,
- The response to the complaint is provided on paper or another durable medium, e.g. e-mail or SMS.
